使用死人的身份證違法嗎
法律分析：根據居民身份證法規定，冒用他人身份證的，由公安機關處200元以上1000元以下罰款，或處10以下拘留，有違法所得的，沒收違法所得，從事犯罪活動的，依法追究刑事責任。但如果是具有法定繼承權或已依法取得代理權的個人，在死者去世後依法行使繼承權或代理權時使用死者身份證，則不構成違法。
法律依據：《中華人民***和國居民身份證法》第十七條 有下列行為之壹的，由公安機關處二百元以上壹千元以下罰款，或者處十日以下拘留，有違法所得的，沒收違法所得：
